特权委员会咋啦?

WHAT IS WRONG WITH THE COMMITTEE OF PRIVILEGES?

It is a pain to watch the examinations of Ms Loh Pei Ying and Ms Raeesah Khan by Minister Edwin Tong and his team. While they try to appear fair, polite, understanding, patient and even sympathetic to the witnesses, it is not difficult to see that all of them were not trying to ascertain facts but were looking for slip ups and words that would make the leaders of the Workers' Party look bad and set the witnesses on a war path with the leaders of the party. It is evident that their line of questioning and suggestions are intended to inflict maximum damage on its leadership.

The committee's hypocrisy is shown from the speed at which their first Special Report was published - on 3 December 2021 or soon after the evidence of the first batch of three witnesses (Ms Loh Pei Ying, Ms Raeesah Khan and Mr Yudhishthra Nathan were taken. In paragraph 6 of the report, the committee arrived at this decision:

"After hearing the above witnesses, the Committee resolved to make the entire video recording of their evidence available to Parliament and thereby to the public through the Parliament website."

If the committee have an iota of consideration for the witnesses, especially Ms Raeesah Khan, they would not have made the video recordings public for audiences not only in Singapore but all over the world. Further, what and where is the urgency for such an interim report to be made public when other witnesses who they intend to call have not testified?

I am exceedingly disappointed by the action of the so called "fact finding" objective of the Committee of Privileges. Totally devoid of understanding and empathy (though Minister Edwin Tong kept repeating "I understand" during the proceedings), they have savaged Ms Raeesah Khan, a victim of a sexual assault. It is hypocritical to continuously use this phrase "victim of sexual assault" and pretend that it would alleviate the trauma of the victim when by their actions, they have aggravated the trauma of the victim. What they should have done was to keep the proceedings within the chambers and publish in written form at the appropriate time as they have done in past proceedings.

PAP ministers are not known for being compassionate to opposition political parties. If they have an opportunity to score political points, they would do their utmost. This means employing means that may not be fair or even contrary to the rules of the game, in this case, parliament. And this is what they have done.

On 4 October 2021, Ms Raeesah Khan was subjected to threats by Minister Shanmugam after she refused to disclose information he requested. He threatened that the police would contact her for "an interview". The police naturally obeyed the Minister and followed up by email requests. All these appear in the police statement annexed to the Special Report.

The minister knew full well when he made the threat that a lie uttered in parliament should be rectified in parliament as it is privileged. Why did he make the threat and instruct the police to investigate Ms Raeesah Khan? Is he taking advantage of Ms Raeesah Khan's lack of experience and ignorance? As a minister for law and home affairs, I do not expect such conduct from him.

Finally, I am not amused at the speaker, Tan Chuan Jin's repeated assurance at the end of the taking of evidence of each witness. Why did he tell each of them "... Do note that the transcript and any evidence given to the committee are not to be disclosed to anyone, not to be published and kept strictly confidential until the committee has presented it report to parliament which means that you are not to discuss this with anyone else and would include your family as well."

Are committee members robots? Do they know what they themselves have done by making the proceedings public even before its conclusion?

观看唐振辉及其团队在审问拉莉莎和 Loh Pei Ying 小姐的听证会视频是令人极其痛苦的。尽管他们对证人尝试表现得那么公正、文雅、理解与耐心,甚至同情心。人们不难看出他们并不是尝试查清事件的真相。而只是在寻找证人在供证的过程中出现不利于工人党领导人的纰漏与字句,从而能够造成为证人与工人党领导人之间进行正面冲突铺路。供证期间的证据显示,特权委员会进行盘问时采取的问话与建议的方式是建立在蓄意对工人党领导人造成最大限度的伤害。

特权委员会的伪善行径表现在于2021年12月3日以迅雷速度上载了在听证会供证的3名证人(Ms Loh Pei Ying, Ms Raeesah Khan and Mr Yudhishthra Nathan)完成供证后的第一份报告视频。在这分报告的第6段,特权委员会做了如下的决定:

“在听取了以上3名证人的供证后,特权委员会决定将全部视频录像3名证人提出的证据。让国会以及公众人士可以到国会网站浏览。”

假设特权委员会具有起码的考量到有关的证人,特别是拉莉莎,他们应该不会把制作成视频的供证会录像供公众人士浏览,不仅仅是在新加坡,而且是全世界。此外,当特权委员会还在准备传召其他证人出席供证前,上载这样一份视频报告的紧迫性目的是什么?

我对于特权委员会进行所谓的‘寻找事件的真相’的这种行为深表失望,尽管唐振辉在听证会上不断的重复‘他可以理解’。但是,他们对拉莉莎成为被性侵的受害者的遭遇完全没有感同身受与同情,他继续使用‘被性侵的受害者’是虚伪的,以及假惺惺地将减轻受害者的痛苦,可是他的行为却让受害者再次受到创伤,实际上他已经在加重了受害者的创伤。他们必须做到是,把供证会的实际情况保留在调查庭,在适当的时候再以书面形式发表,这是他们过去进行听证会所采取的惯例。

行动党的部长们从来就不会为反对党设想(或者同情)而闻名于世,只要他们有机会就紧抓住反对党的(可能犯下的)错误不放,并且极尽权利加以极限的利用,这就意味着使尽各种手段对付反对党,他们在拉莉莎这起事件上,显现国会是不公平,甚至是自相矛盾的。

于2021年10月4日,在拉莉莎拒绝披露更多有关性侵事件向警方报案的详情时,三木根对她提出的恐吓,他警告说,警方将对她进行‘问讯’,警方自然是遵从部长的指示,接着警方就法律电子邮件给拉莉莎,这一切可以在警方发表的声明附件里找到。

部长非常清楚,当他提出恐吓说,在利用国会特权在国会撒谎,必须在国会里进行澄清。为什么三木根要进行这样的恐吓,引进指示警方调查拉莉莎?这是他利用了拉莉莎缺乏经验和无知?身为律政与内政部长,我无法苟同他的这种行为。

最后,我要说的是,我对国会议长陈川仁的讲话并不感兴趣,他在每一位证人供证完毕后不断做出的保证,为什么他对每一位证人说:“……请注意,在听证会上的供词记录和提体给听证会的任何证据是属于绝对机密的,在委员会向国会提交有关的报告之前,绝对不会透露给任何人,也不会对外发表的,这就意味着,你不可以与任何人,包括自己的家人在内讨论与听证会的问题。”

听证会的委员们是机器人吗?在听证会尚在进行中,他们已经把有关听证会的实况公诸于世,他们是否知道自己在做啥?
